Terms and Conditions

1.1 The terms and conditions of use of the e-shop (the "Terms") apply to all legal relations, including offers, orders and sales of products (the "Product"), between the user of the e-shop (the "Customer") and Ivana OÜ, registered company number 16584954, the owner of the e-shop (the "E-shop") (the "Seller"). 

1.2 The Seller may change the Terms and Conditions at any time. Amendments to the Terms and Conditions shall be published on the website and shall enter into force immediately upon publication. By using the e-shop and by placing an order via the e-shop, the Customer confirms that it has accepted the Terms. 

 

2. Prices

2.1 The prices of the e-shop are given in Euro. 

2.2 Prices do not include the shipping costs of the Product. The shipping costs will be displayed in the E-shop prior to the purchase so that the Customer can check them. 

2.3 If the Customer orders the Product from outside the European Union, the Product may be subject to import charges and duties payable upon arrival in the country of destination. Any such duties shall be payable by the Customer. Tax and customs policies may vary from country to country.

2.4 The Seller may at any time change the prices in the E-shop. All changes will be published on the Website and will take effect from the moment of publication.  

2.5 If the Customer's order has been placed before the price change is published, the price applicable to the Customer shall be the price applicable at the time of purchase.

3. Placing the order and payment conditions 

3.1 Add the desired products to your shopping basket to order them. Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid securely via the following payment methods provided by Maksekeskus AS:

  • Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay, Citadele
  • Latvian bank payments: Swedbank, SEB, Citadele and Luminor
  • Lithuanian bank payments: Swedbank, SEB and Luminor, Šiaulių Bankas
  • Card payments: Visa / MasterCard

3.2 The Contract is concluded from the moment the payment reaches the Seller's bank account.

4. Delivery of the product 

4.1 The Seller delivers the Product to the Customer by registered post, by parcel service, self-service lockers, or similar. The Seller will inform the Customer by e-mail when the Product has been dispatched.  

4.2 The Products will be made upon order. Depending on the Product and the availability of materials, the Product will normally take 1-3 working days to manufacture.

4.3 Delivery takes a few working days within Estonia, 7-9 days in Europe and 21 days worldwide. These times are for information only. If the product has not arrived by this time, please contact the Seller.

4.4 The Seller shall not be liable for any delays or problems caused by inaccuracies in the information provided by the Customer when placing the order.

5. Returning the product 

5.1 After receiving the Product, the Customer has 14 days to inspect the Product. If for any reason the Customer is not satisfied with the Product, the Customer has the right to return the Product within 14 days by notifying the Seller by e-mail to info@ivana.ee. 

5.2 The Product to be returned must be in its original packaging and in the same condition as when it reached the Customer. The Product must be unused, i.e. the Product must not have any signs, marks or damage that the Product did not have when it reached the Customer. Products returned with signs of use will not be accepted by the Seller and will be returned to the Customer.  

5.3 In the event that the Customer returns the Product in accordance with the terms of Clauses 5.1 and 5.2, the Seller will refund the cost of the Product to the Customer (the shipping costs will be borne by the Customer). The cost of the Product shall be refunded to the Customer within a period of no more than 14 days from the date of the Customer's return request to the Seller, provided that the returned Product itself reaches the Seller within that period (i.e. 14 days).  

5.4 In the event of a defect, the Customer shall have the right to contact the Seller within two months at the latest from the date of discovery of the defect in the Product. In the event of a defect in the Product, the Seller shall replace or repair the Product or, if this is not possible, refund the cost of the Product. The Seller shall be liable for any non-conformity or defect in the Product sold to the Customer (Consumer) which existed at the time of delivery of the Product and which becomes apparent within a period of up to two years from the date of delivery of the Product to the Customer (Consumer). During the first six months after the Customer received the Product, it is assumed that that defect was present when the Product was handed over to the Customer. During the following 1.5 years, the Seller will cover the costs of resolving the complaint only if it is justified. The Seller shall not be liable if: (i) the defect in the Product is caused by the Customer's fault or negligence; (ii) the defect in the Product is caused by improper use of the Product; (iii) the defect in the Product is caused by normal wear and tear. 5.5 The Seller reserves the right to terminate the Contract if the Product ordered by the Customer cannot be manufactured or if the Product was ordered at the time when there was a typographical error in the price of the Product in the E-shop. In the event of termination of the Contract, the Customer will be notified by e-mail and a refund will be issued to the Customer as soon as possible, but no later than 30 days from the date of ordering the Product.

6. Copyright

6.1 The contents of the E-shop, including, but not limited to, texts, graphics, logos, images, videos and audio are protected by copyright, which are owned in their entirety by the Seller.

6.2 The reproduction, copying, modification or any other use of the content protected by copyright referred to in clause 6.1 without reference to the Seller is prohibited.

7. Use and protection of personal data 

7.1 The Customer consents to the processing of his/her personal data by the Seller. Personal data provided by the Customer when placing an order will be processed for the performance of the contract, to comply with legal obligations, for legitimate interest or with the Customer's consent. 

7.2 The personal data to be recorded includes the data relating to the Customer's order - the Customer's name, address, e-mail address, telephone number, the payment method used and the product selected.   

7.3 The Customer has the following rights in relation to the processing of personal data:

7.3.1 to receive information about the personal data collected about the Customer;

7.3.2 access to the personal data collected about the Customer;

7.3.3 to request the correction of inaccurate personal data;

7.3.4 to request the deletion or restriction of personal data concerning the Customer. The personal data can only be deleted if there is no legal basis for continuing to process the personal data;

7.3.5 to request the transfer of personal data. The customer has the right to request the transfer of personal data to another controller;

7.3.6 object to the processing of personal data;

7.3.7 withdraw consent where the processing of the personal data was based on the consent of the Customer;

7.3.8 to lodge a complaint with the Vendor by e-mail to: info@ivana.ee or with the Data Protection Inspectorate if the Customer considers that its rights have been infringed by the processing of personal data.

7.4 Transfer of personal data to third parties: The Seller shall transfer personal data to third parties only to the extent that is consistent with the purposes set out in Clause 7.1, inter alia:

7.4.1 to processors (courier service, payment to the relevant service providers, invoicing and issuing of invoices, assignment of debt claims).

7.4.2. to public authorities where such obligation is imposed on the Seller by law or other legislation.

7.4.3 on the basis of the Customer's application, to an authorised person or another controller appointed by the Customer (exercise of the right to data portability). 

7.5 The Seller may, with the consent of the Customer, send sales offers, newsletters, surveys and other notices to the Customer at the Customer's email address entered when placing the order. The Customer has the right to withdraw such consent at any time.

7.6 The Seller shall ensure that personal data disclosed by the Customer to the Seller is kept confidential and shall implement appropriate security measures to protect personal data.  

7.7 The Vendor shall store the Client's personal data for the period necessary to achieve the objectives of the contract or for as long as required by law.

7.8 Any queries relating to personal data should be sent to info@ivana.ee. We will respond to such requests within 30 days. If a response requires more time, we will extend the deadline for response by up to two months. We will notify you immediately if we need to do so.

8. Liability and force majeure

8.1 The parties shall be released from the performance of their obligations arising from and in connection with the agreement, in whole or in part, if this is prevented by force majeure, whereby the parties shall be obliged to take all measures to prevent damage to the other party and to ensure performance of the agreement to the greatest extent possible. The existence of force majeure must be proved by the party who wishes to invoke it as a ground for exemption from liability arising from the law and/or the contract for non-performance or non-conformity with its obligations under the contract. For the purposes of the contract, force majeure does not include a change in the economic situation of a party, adverse weather conditions, price increases, holidays, bankruptcy, or a notice of bankruptcy or the securing of an action.  

8.2 Any liability of the Seller shall be limited to the value of the Goods.  

8.3 Links from the E-shop to other websites are not under the control of the Seller and the Seller shall not be liable for any loss or damage that may arise from the use of such links.

 

9. Applicable law

9.1 The Terms and Conditions are governed by Estonian law.

9.2 All disputes between the Customer and the Seller shall be settled by negotiation. In the event that a compromise cannot be reached, the Consumer Customer shall have the right to refer the matter to the Consumer Protection Board or the European Union Consumer Dispute Resolution Platform. Jurisdiction lies with the Harju County Court.
